Dispute prevention: Could BA's troubles have been avoided? It turned from rumors of a cabin crew strike, to strike action confirmed by the union Unite’s ballot to legal squabbling and technicalities. When and how could this escalating scenario have been prevented?

BA bitterness. Stress and strike action

It's difficult to know all the details of what the employees were experiencing on the ground for such a large scale dispute to occur. Cabin crew staff redundancies and remaining crew salary reductions have been cited, but greater bitterness was uncovered by one employee stating: ‘why do the pilots not have to make salary sacrifices when they earn so much more’.

Mediation in disputes or grievances

That sense of injustice brings about the controversial topic of pay; a popular one in the headlines over recent months. Feelings of inequality breed anger but remaining competitive in a capitalist society means enforcing pay cuts in senior or specific roles could result in an immediate impact on talent retention. Such political issues are being universally experienced especially since the dawn of the big R. Have a few companies, such as American Airlines, taken the lead in preventing the growth of small grievances or disputes into full blown court cases? The secret weapon of American Airlines is that of mediation. Mediation is a tool that sounds like a nice chat over a cup of coffee but with proven Results delivered from fully qualified and specially trained mediators perhaps it is the missing link.

Trained external mediators

There were meetings between BA and Unite that despite hope were obviously not effective, with a BA spokesman stating on the 3rd September: "The talks last week were very constructive and we look forward to making further progress later this month." Had they had impartial, trained external mediators present could the outcome have been different? If they had recognised unrest in an employee engagement survey could they have introduced mediators at an even earlier stage to ensure reconciliation? Here at the TCM Group we think the answer is yes because we resolve 90% of disputes and achieve long lasting reconciliation through mediation.

With the CIPD acknowledging that 350 days of management time a year is wasted on trying to resolve disputes, it is obvious something needs to be done to ease the pressure on HR and speed up the dispute to reconciliation time in a more efficient way than browsing the Acas website can facilitate. The government, the courts and more and more private and public sector organisations are using mediation and even training managers internally to be able to mediate, because it effectively avoids the high financial and human costs incurred through litigation, investigations or compromise agreements.

Championing mediation

Organisations such as BT Retail, HSBC, Arcadia Group and Tfl are just some of those championing mediation. As for BA you can’t help but feel sorry that they did not foresee or prevent this now very legal argument. Something tells me Willie Walsh’s Christmas wasn’t that merry this year.
